This Privacy Policy explains how Fond Audio LLC ("Fond Audio," "we," "us," or "our") collects, uses, and protects your personal information when you use our website at https://fondaudio.com, install or use our audio software products, subscribe to our communications, or contact us for support.
We have written this policy in plain English wherever possible. Where legal precision is required, we have used clear definitions instead of jargon. If anything in this policy is unclear, please email us at privacy@fondaudio.com.
1. Who We Are
Fond Audio LLC is a New York limited liability company that designs and sells professional audio software plugins for music producers, mixing engineers, and mastering engineers.

For purposes of the European Union General Data Protection Regulation (GDPR) and the United Kingdom GDPR, Fond Audio is the data controller for personal data collected through our website, plugins, and communications.
2. Our Privacy Approach in Plain English
Before the formal sections, here is what we actually do:
- We do not track you across the web. No advertising pixels, no behavioral profiling, no third-party trackers.
- We do not sell your personal information. Ever. To anyone.
- Our plugins do not phone home with usage data. The only network communication our plugins make is for license activation through our payment partner.
- Our website uses cookieless analytics. Vercel Web Analytics counts page views without storing IP addresses or setting tracking cookies.
- We use a small number of trusted service providers (a payment processor, an email platform, our website host) to operate the business. They are listed in Section 7.

3. Information We Collect
3.1 From visitors to fondaudio.com
When you visit our website, our analytics provider (Vercel Web Analytics) collects anonymous, aggregated page-view data: pages visited, referring website, browser family, country, and device type. This data is collected without cookies and does not identify you personally. We use it solely to understand which content is useful and to improve the site.
We do not use Google Analytics, Meta Pixel, or any third-party advertising or behavioral tracking tools.
3.2 From customers and trial users
When you purchase or download a free trial of our software, the following information is collected through our merchant of record, Moonbase AS, who acts as the seller for our products:
- Name and email address
- Country of residence (for tax purposes)
- Billing address (for paid purchases)
- Payment information (handled by Moonbase's payment processors; not transmitted to or stored by Fond Audio)
- Order history and license entitlements
Fond Audio receives a subset of this data — typically your name, email, country, and license entitlements — for the purpose of delivering and supporting your software license.
3.3 From plugin users (license activation)
When you activate a Fond Audio plugin, our license module (provided by Moonbase) collects:
- The email address associated with your license
- An anonymous device fingerprint (a hashed identifier derived from your device's hardware and operating system, used to enforce installation limits)
- Activation timestamps and license validation events
This data is used solely to verify that your license is valid and to enforce the installation limits described in our End User License Agreement. The plugin does not transmit audio, project data, mix sessions, presets, or any usage analytics.
3.4 From newsletter subscribers
If you subscribe to our newsletter or download our free utility plugins, the following information is collected through our email service provider, Buttondown:
- Email address
- Subscription source (e.g., website signup, free plugin download)
- Email engagement data (whether you opened our messages or clicked links within them)
- Date of subscription and date of any unsubscribe
You may unsubscribe at any time by clicking the link in any email we send.
3.5 From people who contact support
When you email us at support@fondaudio.com or privacy@fondaudio.com, we receive:
- Your email address
- Whatever information you choose to share (typically a description of your issue and any context you include)
These emails route through Cloudflare Email Routing to our internal inbox. We retain support correspondence for as long as reasonably necessary to resolve issues and improve the product (typically up to three years).
4. How We Use Your Information
We use the information described above to:
- Deliver, activate, and support the software you have purchased or downloaded
- Process transactions, prevent fraud, and handle refunds or chargebacks
- Send you product updates, beta announcements, release notes, and occasional marketing communications (only if you have subscribed)
- Respond to your support inquiries
- Understand which parts of our website and product line are useful, in aggregate
- Comply with our legal obligations, including tax and consumer protection laws
We do not use your data to build advertising profiles. We do not share your data with advertising networks. We do not sell your data.
5. Legal Bases for Processing (EU/UK Residents)
If you are located in the European Economic Area or the United Kingdom, our legal bases for processing your personal data under the GDPR and UK GDPR are:
- Performance of a contract — to deliver the software you purchased and provide license services (Sections 3.2, 3.3)
- Legitimate interests — to operate and improve our website (Section 3.1), respond to your inquiries (Section 3.5), and prevent fraud
- Consent — for marketing communications (Section 3.4), which you can withdraw at any time
- Legal obligation — for tax records, accounting, and compliance with applicable laws
6. International Data Transfers
Fond Audio is based in the United States. Our service providers are based in the United States and the European Union. If you are located outside the United States, your personal data will be transferred to and processed in the United States and other jurisdictions as part of using our services.
For transfers from the European Economic Area or the United Kingdom to the United States, we rely on:
- Standard Contractual Clauses (SCCs) approved by the European Commission, where applicable
- Service providers' compliance with the EU-US Data Privacy Framework, where applicable
- Other lawful mechanisms appropriate to the specific transfer
Note on EU representative. Fond Audio does not currently maintain a designated EU representative under GDPR Article 27. EU residents may exercise their rights and contact us directly at privacy@fondaudio.com.
7. Service Providers and Sub-processors
We use the following service providers to operate Fond Audio. Each is bound by data processing terms and uses your personal data only for the purposes for which we engage them.

We do not use Google Analytics, Meta Pixel, advertising trackers, behavioral analytics platforms, session-replay tools, or customer relationship management platforms.
This list reflects our current service providers and will be updated as our infrastructure changes.
8. Data Retention
We retain personal data only as long as necessary to fulfill the purposes for which it was collected, or as required by applicable law.
- Customer purchase records: retained for the duration of your license plus seven (7) years for tax and accounting compliance
- License activation records: retained for the duration of your license, plus a reasonable period for support purposes
- Newsletter subscriptions: retained until you unsubscribe, then deleted from active marketing systems within thirty (30) days
- Website analytics: aggregate data retained per Vercel's standard retention; not personally identifiable
- Support emails: retained up to three (3) years from the last interaction
When data is no longer needed, we delete or anonymize it.
9. Security
We take reasonable technical and organizational measures to protect your personal data, including:
- Encrypted data transmission (TLS/SSL across all websites and APIs)
- Encrypted data storage at our service providers
- Access controls limiting who at Fond Audio can access personal data
- Vetting service providers for industry-standard security practices
No method of internet transmission or electronic storage is fully secure. While we work to protect your data, we cannot guarantee absolute security.
10. Cookies and Similar Technologies
Our website does not set cookies for tracking, analytics, or advertising purposes. The website may set strictly necessary cookies if required for core functionality (for example, a session cookie if you log into a future customer account area), but no third-party tracking cookies are used.
Our analytics provider (Vercel Web Analytics) operates without cookies by counting page views server-side using anonymized signals.
If our cookie usage changes in the future, we will update this policy and, where required, present a cookie consent notice on the website.
11. Your Rights
11.1 Rights available to all users
Regardless of where you live, you may:
- Access the personal data we hold about you
- Correct inaccurate or incomplete personal data
- Delete your personal data, subject to our legal obligations to retain certain records
- Unsubscribe from marketing emails at any time using the unsubscribe link
- Contact us with questions or complaints at privacy@fondaudio.com
We will respond to your request within thirty (30) days. We do not charge for handling reasonable requests.
11.2 Additional rights for EEA / UK residents (GDPR)
If you are located in the European Economic Area or the United Kingdom, you have the additional rights to:
- Object to processing based on legitimate interests
- Restrict processing in certain circumstances
- Receive your personal data in a portable, machine-readable format
- Withdraw consent at any time, where consent is the legal basis
- Lodge a complaint with your local supervisory authority if you believe we have not complied with the GDPR
11.3 Rights for California residents (CCPA / CPRA)
If you are a California resident, you have the right to:
- Know what personal information we collect, use, and disclose
- Delete personal information we have collected, subject to legal exceptions
- Correct inaccurate personal information
- Opt out of sale or sharing — Fond Audio does not sell or share personal information for cross-context behavioral advertising, so this right is automatically honored
- Non-discrimination — we will not discriminate against you for exercising your rights

11.4 Rights for other US state residents
If you reside in Virginia, Colorado, Connecticut, Utah, Texas, or another US state with comprehensive privacy laws, you have rights substantially similar to those described above for California residents. Please contact privacy@fondaudio.com to exercise them.
12. Children's Privacy
Fond Audio's products and website are intended for adult users — specifically professional and amateur audio engineers, music producers, and musicians. We do not knowingly collect personal information from children under the age of thirteen (13), and our services are not directed to children.
If you believe we have inadvertently collected information from a child under thirteen, please contact us at privacy@fondaudio.com and we will delete the information promptly.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The current version will always be available at https://fondaudio.com/privacy with the version number and effective date indicated at the top.
If we make material changes — for example, adding a new category of personal data, a new service provider, or a new purpose for processing — we will notify users via email (for current customers and subscribers) and post a prominent notice on our website at least thirty (30) days before the changes take effect.
Your continued use of Fond Audio products and services after an updated policy takes effect constitutes acceptance of the updated policy.
